I was so cross after being pulled over this morning that I nearly ran out of petrol on the A40.

Came out of my drive, turned right down the High St, then left at the mini roundabout and noticed the Police 3 cars behind with their Blue lights on.  I indicated, pulled in then, the car behind me did the same and the Police off sided the first car to get round and park behind me.  I was a little confused as I assumed they were off on an emergency.

Copper gets out, I wind down the window, off with the Radio.

Copper - we've pulled you over because you were using your mobile.

Me - Nope absolutely not (although I felt like saying no you didn't pull me over as you were 3 cars away when I got out of your way.... but never mind)

Copper - Well we've pulled you over because I saw you using your mobile.

Me - Absolutely not, I wasn't on the phone

Copper - Where is your phone then?

So I reached into the foot well to get my hand bag, pulled out a pair of shoes, my lunch box, a yoghurt, a banana and then found my phones.

Copper - you got 2 phones?

Me - Yeah?

Copper - oh all right then

and he feckin walked back to his car, no apology, no sorry for accusing me of breaking the law and telling me that he saw me on the phone when I clearly wasn't.

Just because I have bird poop covered BMW doesn't mean I'm a cock.

grr

Yeah already had that conversation with someone in the know and it goes like this...

I make a complaint to the duty sargent at Hillingdon, Duty Sarg tracks down which squad car was in the area at that time an finds the copper needing glasses, Copper says 'ah yeah I forgot to write her up', he then files the report, I then become the loser as I waste my time having to go to court to prove that I wasn't on my phone.

All I wanted was him to admit that he haddn't seen me on the phone and that he was sorry for pulling me over.  I felt like such a criminal be told that I was doing soemthing that I wasn't.

'ah yeah I forgot to write her up'?  Coppers have to declare that they are going to report you at the time they stopped you.  Such a comment indicates that the copper didn't give advise you of that at the time and that he is forgetful and therefore clearly negligent in his duties.

Yep I agree Aceman.  At the time of the encounter with the copper he didn’t say that he was going to write it up but he didn’t admit that he was wrong either.  Back someone into a corner and they will either concede or fight.  In my one to one with the copper he didn’t follow protocol in tackling the alleged offence and he didn’t apologise for his accusations.  So my complaint would call to question the coppers lack of observation and his decision making skills of chasing an alleged criminal for a minor offence (in my opinion) and then not following rules of engagement.  He said that he saw me on my mobile and that was why he stopped me, but I wasn’t on my phone so how could he have seen it? He didn’t ask me if I was on my phone, he told me I was.

By registering a complain and calling to question the integrity of that copper would be like backing him into that corner; do I think he would concede to his superiors?  Nope.  So I waste my time with a complaint.

Your phone bill will show you did not ring out, but then prove nobody rang you ?

Guy sounds like a twat, to many of them around, i have fun reporting them now, for jumping lights, indicators not working, cutting up traffic by plain bully boy tactics and thats just the traffic ones.  ':p'

right, i have right enough of this attitude towards patrol on our streets.
police cant get it right can they?
if they stop you to check on you then they have 'ruined your day', exactly how?  by asking a question and making a wrong statement about you?  boo hoo!
if they DONT stop people, then 'they are not doing their job, look at that wa***r with his mobile phone while eating a sandwitch, where is the police when you need them', etc.etc.
i say, welcome to any officer who bother these days to get off their car on suspicion of somebody driving while being on the phone, and being wrong.  at least they're doing something!!!  '<img'>

Hope you have miss read what was said, was not the fact of being pulled over, it was the attitude when wrong.
People in general do not have issues with the Police, only those that think they ARE the law, break the law when supposed to set an example and general attitude toward the public and ethnic minorities.

i'm sorry i dont think i miss read it, i think their attitude was pretty normal and the statement that a simple routine check could 'ruin your day' that is what really revves me up.
and why would he have to apologise when he was doing his job correctly???  they do have the right to pull you over for whatever reason they may think they have, you know.

actualy.. i dont think they have the right to pull you over for just any reason, its my understanding that they have to have justifiable reason for doing so, this is not a police state no matter what the media tries to tell us, we all have rules to follow.
If a polis wants to pull me over and check my bike/docs then go for it, i have nothing to hide or worry over but if id been pulled over, then accused of an offence, then disproved the officer id expect at the very least an appology, and if i didnt get one then id be asking his Desk Sergeantwhy not.

so perhaps there was a 3rd phone taht you're not telling us about, perhaps when u saw the coppers, you slid it under your seat, knowing that you could show them 2 phones in your bag?

just checking other possible scenarios...

the polis have too much power if they can just pull u over if they want to, that is simply pathetic, what next..
If i was riding in any manner that caused them concern then thats acceptable, if the ANPR screwed up(and it does from time to time, after all, crap in/crap out) and flagged an issue I'm happy to stop and talk to them, any other reason then piss off, go stop a mugging or burglary instead.

or go dress up in riot gear and assault a member of the public

Surely you can't be serious?

I don't think any police officer will pull you over for no good reason.
You pay your road tax, insurance, have a valid MOT and license what have you got to worry about?

I do like how you edited your post though....

Rights to stop and search I believe were bought in for mostly the right reasons and lets face it, they rairly affect us as bikers, mainly because we're so visable, they're going to see us stuff something inside our leathers rather than drop something disgretely under a seat etc.

I genuinely don't know of anyone on this site who doesn't have all they're documents, lets face it, it would be silly to ride without them, as we so often loose out in accidents due to our size, to give the insurance company's any excuss not to pay out in our favor when it's been prooved we were not in the wrong, except riding without an MOT for example is just insane.

So in this case sorry Riz, but I think it's Scotland nil, Germany 1     imho
