Hi Minnie, thanks for asking.
Need to confirm opening hours with shop first... Called the shop but there was no answer. Will call again.
As far as getting down there, and putting together a few people to accompany me and be witnesses, I have a friend who can come with me on Wednesday - if I pay for van hire @ £50 per trip, which I found on MCN.
Alternatively, a colleague has offered to come with me (presumably NOT on a work day), and my neighbour who has a school-bus-with-no-seats-and-limited-anchorage-points is happy to take me there on Saturday.
Is Saturday any better for you to come with us?

Matt you be surprised in what i can do if people have mis sales Dosen't even take me long to get a refund and I go through the Proper Proceeds , but have a way in speeding it up usally

I take it you bought this bike over the phone with out seeing it?
How do you know the dealer ticked the box on the form to say no V5 present due to insurance salvage?

Burger, it's like this... At the time, based on information I was given, I believed that the bike was "buy-able", so let's ust start from there.
I decided to buy, and the guy at shop went hunting for the log book. They didn't have it.
So I filled out the V62 to apply for new log book, signed it, with some bits blank and was told that they would do the rest, and paid up in full.
2 weeks later (on 30 May) I got letter from DVLA, with the V62 that I signed attached. The shop had ticked the box on the form to tell the DVLA that the bike is a Cat C.
That's how I got to know.
This has become far too fishy and I SWEAR I WILL NEVER buy from a non-authorised dealer ever again.
I just want my money back.

MArge simpson hhhhhmmmm, So you bought the bike with all the damage visable but they did not tell you it was a write off?
DVLA can not confirm that its a registered write off?
A HPI check cant confirm that its a registered write off?
Maybe that the it aint a reistered write off, That its all fine and the dealer ticked the easiste box on the form to avoid pissin around and applying for a new one?
Plus any dealer knows that no one in their right mind would buy a bike without a V5 present from an unauthorised dealer so they prob thought they were never gonna sell it and would rather just tick the box to say it had been lost.
Im not trying to be critical but Im just saying you might actually have a decent bike, You might have a bike that could be put right for the same money you saved buying one in good conidtion. HAve you spoken to them since? HAve you spoken with the person who sold you it? Have you costed up the parts to put it right? Have you contacted a salvage dealer to find out how much the bike is worth. Serious, You may have a decent motor there. And you said it before you do like the bike.

Burger, thanks. You might be right had it been a different bike. 2 people have looked at it separately after I have bought it. The two people don't know each other, AFAIK, yet they have said very similar things.
HPI and DVLA were exchanging notes so I need to call them again on Monday to see what progress they have made.
Keeping it would be the Plan B that I don't want to execute.

V62 form is not dealers responsibility to fill in it yours,
Did you ever have any of the paper work of the bike?
Did you ever have the little green slip off the log book V5c?

I second that things can work out alot better if theres People to Support your Claim but can rest assure you over payed on the bike
Ps . I Got a Problem too sort out at 8:30Am this morning if it Don't Sort, I hope i have Support to help me Sort it out?,
I Believe us People hate Rouge Traders and we can have our own law With in Legal limits So war it is if Problem Don't Sort then i'll put up a thread with Plan of Action as if the idiot Can get away with theft and deception with full evidence Against him then Authoritys will be Questioned

Hi Yam-RDIB - best of luck with your "negotiations" with your dealer too.
No, my dealer did not ask for money for V62 form. That's why DVLA sent it back to me, and that wasy how I found out about the Cat C.
Absolutely NO paperwork for bike.
Never saw any green slip.
HPI result:
Bike not recorded stolen
Bike never recorded as write off. Have sent HPI and DVLA to investigate as bike has been ina ccident before I bought it.

EDIT: The guy that speaks English better won't be in till 11:30.
2nd EDIT: Phoned RAC re HPI check. HPI and DVLA are still exchanging notes about just who is right about the Cat C.
No matter what - according to the DTI:

Sue the shop, a small claims court summons is dead easy to draw up and when the bailiffs start taking thier goods away the shop will rue the day they messed with ya! If you need help with drawing a summons Pm me.

I could always go in, say 20 mins in advance and realy talk the chap up for buying a R1 or sim, claim im looking ot trade my bike in... get him all hot and eager, then u walk in, and i change mind because u start screaming the place down (marks will be given for style and grace), nothin quite like a lost sale to change minds

Just spoken to the mobile mechanic who I found on here - he's all booked up this week!!! Drats drats drats drats drats.
Eventhough my eyes are pretty good with these things, who am I to say to the shop with authority that the forks are bent? I need a professional assessment on the bike's forks QUICK. Anyone?
