I got a call from the HPI just a few moments ago and "Wonky" (the bike) has slipped the Cat C. It is officially not, a Cat C.

Even though the reason for taking the bike back was not hinging on the Cat C, I am gutted as this weakens the "not as described" argument!


This changes the game plan a lot. Any suggestions?

It not being listed as a cat c doesn't affect your claim, you now have the not fit for purpose argument, (sale of goods act).

Cheers, Dan. Looking at it now. I owe you at least a beer, I tell ya! This whole thing is stressing me out, but I am so glad to have you and everyone supporting me '<img'>

LOL - I suppose there is the Supply of Goods and Services Act too, where they did not lower the bike as promised. If I had not INSISTED to have the seat carved, I would not have been able to ride it at all! There's L plates that they "forgot" to put on too - but I got the plates in the end and I am not holding it against them.

A thought that occurred last night was, how did you pay for the bike? If you have paid any of the cost, even just a small deposit by credit card then you enjoy protection under the consumer credit act and then the credit card company have to get involved and then thier legal team has to do all the hard work for you.

I missed that, my bad, but the advise is there if any one else has similar problems. I paid for my bike on my credit card when i bought it for the above reason.
