Chaps and Lasses,

As you know my bike was recovered from italy by a third party working on behalf of the AA. It was returned back to the Uk with half of its plastics missing with a cost to replace of £1500 by Yamaha.

IT seems that the plastics have gone missing between collection from Alba's folks and delivery to the AA's counterparts in Parma.

IT has been 5 weeks since by bike was recovered and still no joy. Problems with translation and people trying to avoid me has prolonged the bike getting back on the road. Im not sure from the Terms and cons that the AA are liable for these costs?

So Im not sure what to do???

I think Im gonna call the UK and italian police and report the theft's to my insurance company as back up. Then start a claim against the AA to get it resolved quicker.

What do you think is the best solution?

this is shite mate - unfortunately, technically speaking - according to the T&Cs - AA are not liable for this.

The responsibility and blame will be at the feet of the 3rd party company...

But i think you have a very strong case for getting AA to either 1. compensate you directly, and they should take the loss on the chin or 2. Get them to help liase with the 3rd party.

IMO I think your next step should be write a strong letter to AA explaining the situation and ask them for an immediate response, and ask them what they can offer you in terms of compensation or help in recovering the parts. Ofcourse, you are a 'loyal' customer who has strong links with the bike community in the UK, and have often recommended the AA to fellow bikers as you have always found customer service (up until now) impeccable...blah blah If they can not help recover the parts, you will want to know how they can compensate you for your immediate financial loss - loss of no claims and excess, should you claim on your insurance or cost of replacing parts, and what they can offer in terms of compensation for the 'massive' inconvenience its caused you. Lay it on thick - if you can be bothered, kick up a stink, you might be able to take away something from this mess!

Regardless of their terms and conditions, they still have a certain responsibility to you as a customer to make sure that they dont put your property in the hands of some dodgy dealer back street garage.

That’s disgusting Rich. The AA are responsible for your bike / car until it reaches its destination. I think some strong letters to them ultimately threatening legal action in the small claims court will do the trick. The AA won’t want the publicity of legal action, and possibly fold. If not your have to issue a summons. It’s not as daunting as it sounds. Nine times out of ten they won’t contest it, and you will automatically win.

i'm with riz. the aa have a responsibilty. presumably, the fairings were attched to the bike at the time.

what would happen if a car was returned without its doors???

we're not talking about contents of the glove compartment, we're talking about actual parts of the vehicle.

Also worth telling your tale of woe to the personal finance desks of the newspapers.

The Independent's "Spend & Save" supplement on a Saturday is always full of tales of reticent banks, insurers and retailers caving in to avoid bad publicity. Obviously the paper only ever reports its success stories but it's worth a go...

Another thing I was thinking last night, why do the AA inspects the condition of your car / bike before they recover it. I also thought it was so you don’t claim for damage that was already there? It which case if something was missing from the bike it should have been listed and signed for before the bike was picked up?

Its hard trying to write a letter that means so much to you sometimes.
Our emotions do sometimes get in the way, which is only human.
The simple facts are, you have been poorly treated, and the level of professionalism
is not what you would have expected from such a large institution.
Your bike has been damaged whilst in their care, and for that they are liable.
You are seeking advice from a number of sources and your understanding from these
sources is that you have been poorly treated and to an extent you have been undervalued
as a fully paid up member of their association.
You would like to continue your association with their organisation so that you can move
forward together to speedily resolve a situation that is still causing you some concern.
Let them know also that you have been in the past and hopefully in the future one the first
people to herald the benefits of being a member of the AA.
You also understand the logistics involved can sometimes be time consuming and complicated
but you did in your opinion allow for a sufficient amount of time for this etc.

Butter and sugar go well in every situation I find.

Arrgh not that it matters any way. I think I have just had about enough of this crap, I think my ability to smile and laff through any situation has just rubbed off. Lets face it, Life througs some crap at all of us and some are built to take it and others to cave in.

Just spent the last 2 days re-building the bike in a vain attempt to save some money whilst blowing 300 notes on Alba's cos it badly needed a service due to the massive thrashing it had through swiss land etc.

Stripped all rad down, down pipes etc, removed bollocksed end can (another £400 notes down the pi**er ). and swapped out the sump. Re-built with success to find that an engine management error code is displayed which has stopped the bike running. So it needs to go to Yamaha and have some more notes on it spent even though it looks like a raped version of a fazer.

Oh joy, Life is full of fun aint it, still not long to go before my birthday, THATS ALWAYS A friggin hoot, I wonder what will happen this year, Another week in intensive care? Maybe another night in cells, or we could have a fresh change and try getting stranded in another country, arrgh no thats April not June! DUH

I take it your feeling a wee bit down mate.
I am getting to the point where I am gonna have to either spend what I have left
(in my emergency stay away from a job I fuckin hate fund) on a bike that is proving
a little underpowered for me or go back to my day job '<img'>
My little holiday from work is coming to an end alas.
I spent all last summer in a cast, had to sell my car, and my bike, to pay the rent,
and buy loads of fags because of all the time on my hands.
Man that was a fucking hard summer.
Things will get better mate keep plugging. '<img'>
