Indeed... as bad as it sound I was thinking same... that it was my fault. If I was in a car I know this would have not happened, main reason because if I turned right he would have accelerated past me , I can assume more then 30mph so he was dangerous driving. I should have known better...

What if he was on teh phone and woudl have been there for liek 20 minutes, I seen people stop in middle fo road to talk on the phone and traffic has to overtake them... I don't know anymore.... I was stupid really, but I guess this is a big slap for a wake up call.

Guys... hold on... yes it was my fault I over took him, but the accident happened a bit later on. So what happened is I overtook him and he raced after me and hit me.

How can he be in the right? Does that mean every time someone cuts me off or jumps light I have the right to chase after him and damage his car? The issue is that he did not like that I went first... if it was an older driver or someone that had more intelligence they would not bother racing with a bike or go after it, it's not like I hit him or made him avoid me or anything.

So Tallguy keep this in mind and tell me again... was he in the wrong? or was I?

Like I said, I was in the wrong because of the overtake but that did not cause the accident... what caused the accident is the guy deciding he would take the law in his own hands by going over the speed limit.

Please forgive me if you thought I said he was in the right, he is not. But evidentially he can't be shown to be in the wrong either as you don't have witnesses. It is your your own evidence which puts any blame on the car driver and unless his car was damaged and the police have seen and examined it that evidence is uncorroborated. Just one independent witness and the whole situation could have been so different. Though what would the witness have seen? A bike trying to race a car or a speeding car trying to undertake a bike? I know which one I’d put my money on.

RSS are still worth a call though.

I think you have a point.  The way i see it i would of probably done the same as you at the juntion BUT on approaching the juntion approached really slowly at the same time looking left and right then nailed it when there was a gap.  I think the guy may of got pissed off because you probably blocked his view while he was at the juntion.  Anyway as you rightly imo got infront of him on the straight then i would of had proper road postioning which would not allow him to get to the side of me.  Did he hit you up the arse?  My take on this is what you really did wrong was.  Not looking at the juntion early enough and 2 bad road positioning to allow him to knock you off.  I do think you learnt from this and know your partly to blame.  To be honest with you had i been in the same situation and say he did chase me down the road and knocked into me.  I know i would of lost it and by now getting a summons for GBH beause quite frankly what he did is inexcusable and basically could of killed you.

Well thats my take on the crash.
Book a day training with the police they will teach you most of what you need to know in a long day and is without doubt the best you can spend your money on right now when you get the bike back sorted.

I will do that mate... and I have 2 witnesses that saw him come behing me and smack me...:) so maybe I have something to nail him on.

Once bike is repaired I will get on a Advanced course or Police day.

Wo wo wo wo, Drei, Dont repait the bike. Call you insurance company and just say,

"I was struck from behind, The driver left the scene but I have his details, Here are the names of the witness that saw it"

Fuck all the junction bollocks mate, Just call them and tell them the minium facts, let them decied who was at fault. Come on brain on! ':p'
